The owners of Roseland Court nursing home have submitted to Cornwall Council an application for a certificate of lawfulness in relation to various changes that they wish to make in order to convert the current use as a nursing home to residential accommodation. It should be noted that the owners contend that the changes will not result in a change of use as defined in the rules around planning and, therefore, the changes do not require planning permission. Cornwall Council, as the local planning authority, will need to determine the application on the technical and legal issues rather than the merits of whether or not it is a good idea to make the changes proposed.

We have been advised by the Cornwall Councillor, Julian German, that the application will be reviewed not just by the planning case officer but also by Matthew Stephenson (Group Leader) and Hayley Jewels (Head of Development Management) before the application is determined.
